TERMS OF PURCHASE
The following terms (the “Agreement”) shall be effective upon execution of the purchase process by you (“Customer” or “You”).
WEDDING PURCHASE
Your Agreement with Beach Weddings with Style LLC (together with its contractors) will last for the term specified for your upcoming wedding. NO TANGIBLE PERSONAL PROPERTY IS TRANSFERRED TO THE CUSTOMER IN THIS CONTRACT.
CONTRACTORS
Beach Weddings with Style LLC contractor list is continually evolving. There is no guaranty that during the Initial Term or any Renewal Term any third-party partners that previously worked with Beach Weddings with Style LLC Network will remain the same. Partners may be added or removed at any time without notice to Customer.
PRODUCT UPGRADES AND CHANGES
Beach Weddings with Style LLC is constantly reviewing its product and service offerings to strive to provide its customers with the best options available. Beach Weddings with Style LLC retains the right to revise its product and/or service offerings, at any time. Additionally, Beach Weddings with Style LLC reserves the right to add additional products and services. Purchase of a current product or service does not guarantee the exact setup – our Wedding Packages are constantly evolving in a positive manner to offer our clients more for less. You will not be charged for upgrades if we increase features (‘Amenities’) that differ from the original purchased package.
WEATHER
Weather in Tampa Bay area is extremely unpredictable. Forecast may change throughout the day, hour by hour, we will always do everything in our power to work with you. Depending on the severity of the rain, you may not be able to have your ceremony as we planned. If there are any breaks in the weather, we will head out on to the sand for more pictures and celebration. If case a storm doesn’t let us have your wedding, we can decide to have your ceremony on the next day, or choose another date for up to 365 days from the original ceremony date (depending on our and vendor availability). Being flexible with your wedding time is something to expect as sometimes we may need to move the wedding time to avoid the rain. Having Event Weather Insurance is great for hurricanes and storms. Having wedding insurance is essential since the weather is Florida is unpredictable. Should the wedding need to be moved into alternative location and it is available, this option is an accommodation and may not include all the setup materials originally included with your wedding package. There will be no ‘discount’ in this event as we will do our best to setup as much as we can accordingly. In all cases, we are not responsible for weather related events and their potential risks associated. We will always make every effort to have your Beach Wedding out on the sand!
CEREMONY TIME
The Location and Time Booked is not guaranteed. We are subject to different Municipalities, Cities, National Parks, County Parks, Local Government, and State Parks – we make every effort to ensure the original location is reserved as quickly as possible, however, this is an active calendar and last-minute bookings can occur. Further, other events may take precedence (Festivals, Concerts, Food Rally’s, etc.) and we are subject to cancellation. We ask that couples remain flexible as we always work in their best interest to find a suitable alternate location and date in this rare event.
PARKING
All locations are subject to Public Parking. Please plan accordingly for parking and unusual traffic patterns. It’s always best to arrive early and stay in an air-conditioned car as we start promptly on time. Certain locations include the Entrance Fee. We are not allowed to reserve parking spots. That’s why we recommend avoiding the middle of the day on Saturday/Holiday weekends. Most locations have metered parking and can range from $1.50-4/hour or a flat fee for the day.
CANCELLATION/DEPOSIT
Non-refundable deposit is required to start a planning process. By purchasing a ceremony package on our website your will get an estimate on how much can that be. You can pay right there on check out or via email link after our phone call. The remaining balance is due no later than 60 days before the wedding date. If the payment is 5 days late your wedding will be canceled.
If you cancel your wedding ceremony, the full amount for all payments made shall not be refunded.
TIMING, BEACH LOCATIONS, SEATING, PUBLIC/PRIVATE LOCATIONS
Saturday or Sunday mid-day or even early afternoon is not the best time for a wedding (beach goers, parking, traffic, etc.). We instead recommend before 11am or after 4pm to avoid the busiest time of the date. If you will be in town for the week, we highly recommend Monday – Friday (non-holiday weeks)! Certain locations provide more privacy than others. Further, the only way to have a completely private location would be on Private Property facing the Gulf of Mexico. We recommend all guests seated during the ceremony. There are several reasons for this: Line of Sight for the Photographer and overall organization of the event/ceremony. The Permit obtained does not guarantee us a location. All of the locations we service are located in Public Beach & Neighborhood Access points, therefore not Private Beach. If you have specific questions regarding this, please don’t hesitate to call/email us anytime.
GENERAL PAYMENT TERMS
Customer may purchase products and/or services in a variety of ways including Self-Checkout or email with a sales quote and payment link. Minimum deposit is required to reserve the date, permit, and vendors, and all payments need to be paid completely 60 days prior to the scheduled wedding. By completing the purchase transaction, Customer agrees to pay for the products and services provided by Beach Weddings with Style LLC with a valid credit card on Make A Payment link on our website.
UPGRADING PRODUCTS & SERVICES
Customer may add or upgrade additional products and/or services at any time by contacting Beach Weddings with Style LLC or by accessing customer’s features on the Website. Upgrades to existing products and services will be deemed as a new contract with the pro-rated refund on the Wedding Package applied directly. The fees for new products and services will be based upon the then current, generally applicable fees.
NON-TRANSFERABILITY OF PRODUCTS & SERVICES
The products and/or services purchased are valid only for the Customer, and in the category and region specified at the time of purchase and may not be transferred either to a different Customer or by the same customer to a different category or region.
U.S. DOLLARS & U.S. TRADE REGULATIONS
Customers will be billed in U.S. Dollars and subject to U.S. payment terms. In no event shall any transactions be in violation of U.S. trade regulations. There shall be no refunds for products and/or services provided by Beach Weddings with Style LLC. All amounts required to be paid hereunder do not include any amount for taxes or levy (including interest and penalties). Customer shall pay all sales, use, VAT, excise, property or other taxes or levies which Beach Weddings with Style LLC is required to collect or remit to applicable tax authorities.
INCORRECT BILLING
If Customer believes Beach Weddings with Style has billed incorrectly, Customer must contact Beach Weddings with Style LLC no later than thirty (30) days after the Billing Date in which the error or problem appeared.
MODIFICATIONS
The parties agree that this Agreement cannot be altered, amended or modified, except by a writing signed by an authorized representative of each party.
NO WAIVER
No failure or delay in enforcing any right or exercising any remedy will be deemed a waiver of any right or remedy.
GOVERNING LAW
This Agreement is governed by the laws of the State of Florida (“Governing Law”), without regard to principles of conflict of laws of any state or jurisdiction. Customer hereby agrees that the courts located in Florida (“Place of Jurisdiction”) shall have exclusive jurisdiction over any dispute arising hereunder.
LIMITED LIABILITY
IN NO EVENT SHALL BEACH WEDDINGS WITH STYLE, OUR EMPLOYEES, OR OUR SUPPLIERS BE LIABLE TO CUSTOMER OR ANYONE ELSE FOR DIRECT, INDIRECT DAMAGES, LOST PROFITS, ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES OF ANY KIND WHATSOEVER ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE SITE.
INDEMNIFICATION & HOLD HARMLESS
Customer agrees to indemnify and hold Beach Weddings with Style and our affiliates, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising in any manner in whole or in part out of Customer’s use of the Site, Wedding Ceremony and its risks associated, or its violations of its representations, warranties or obligations under the Agreement. Client agrees to indemnify and hold harmless Beach Weddings with Style LLC its affiliates and employees, from and against any and all liability, damages, costs, losses, claims and expenses, however caused, resulting directly or indirectly from or connected with Beach Weddings with Style LLC negligent performance of this Agreement (including, but not limited to such liability, cost, damage, loss, claim or expenses arising from the death of or injury to, or damage to property of Beach Weddings with Style LLC, or their respective employees or agents). Beach Weddings, outdoor events, and their related services are inherently dangerous and subject to many external uncontrolled factors (Weather, Traffic, and their municipalities but not limited to). Beach Weddings with Style LLC expressly encourages couples to review and assess all risks involved with an outdoor event and the potential imminent danger in which Beach Weddings are conducted. We reserve the right to make changes to this policy at any time.
